ACCEPTANCE OF PRIVACY POLICY

By using the Winds mobile applications (Patron, Partner or Captain) (the “Platform”), you, the customer ( “you”, “your”, or the “User” in this document) unconditionally agree to the terms and conditions that we have provided herein for the use of the Winds Platform.

This Privacy Policy ( “Policy” ) describes our privacy practices in plain language, keeping legal and technical jargon to a minimum. While you are enjoying the Platform, we collect some information about you in accordance with this Policy.

WHO WE ARE

The Platform is operated by M/s Winds E Pvt Ltd, listed in the class of Private company and classified as Non-govt company. This company is registered at Registrar of Companies(ROC) having its Corporate Office at 2nd & 3rd Floor, 235, Suraj Centre, 27th Cross, Corporation Ward 59, Yediyur, Jayanagar, Bengaluru Karnataka 560082 (“Winds”, “we”, “us” or “our” in this document).

WHERE THIS POLICY APPLIES

This Policy applies to all Users of the Platform. Our Terms and Conditions and other policies and regulations (“Terms”) are incorporated herein by reference. All defined capitalized terms in this Policy shall have the same meaning as defined in the Terms unless otherwise provided for.

INFORMATION WE COLLECT

Our services require us to collect certain information from you (which includes personal and sensitive information), apart from which we also collect information through third party service providers and your regular interactions on our Platform. Further information on what all information is collected is given below:

Information You Give Us

  • When you create an Account, we would require you to furnish certain information about you:

    • Name;
    • Address;
    • Mobile Number;
    • Email ID;
    • Date of Birth;
    • Gender;
    • Location;
    • Aadhar Number;
    • You will also be required to create a password in connection with registration of your Account. Once you register, you will be able to review and change this information at any time by logging in to your Account.
  • We may also require you to furnish certain other information such as your bank account number, name, IFSC Code, Credit Card information and other payment processing information. Such information may be shared with the Payment Processor as well.
  • We may also require you to furnish information about your corporate entity or business such as - Name, Corporate Identification Number, Address, GSTIN, PAN, and other relevant information.
  • You may provide certain information while giving feedback or comments (if permitted on the Platform);
  • When you choose to participate in our promotions, events or contests, we collect information that you use to register or enter;
  • If you contact our customer care team, we collect the information you give us during the interaction. Sometimes, we monitor or record these interactions for training purposes and to ensure a high quality of service.
  • If you ask us to communicate with or otherwise process information of other people (for example, if you ask us to send an email on your behalf to one of your referrals), we collect the information about others that you give us in order to complete your request.

Information We Receive From Others

In addition to the information you provide to us directly, we receive information about you from other, including:

  • Referrals: When another user of the Platform (being a Patron, or Partner or Captain) refers you to join our Platform, they may provide us with information about you such as your name, mobile number, email address or other similar contact information;

Information Collected When You Use Our Services

  • Usage Information: We collect information about your activity on our services, for example how you use them (such as date and time you logged in, your searches, clicks and pages which have been shown to you, any advertisements you click on) and how you interact with other users (such as the Partners/ Patrons/ Captains you connect and interact with or refer, time and date of your exchanges, payments you send and receive).
  • Device Information: We collect information from and about the devices you use to access our Services, including:

    • Hardware and software information such as IP address, device ID and type, device specification and app settings and characteristics, app crashed, advertising IDs, browser type, version and language, operating system, time zones, identifiers associated with cookies or other technologies that may uniquely identify your device or browser;
    • Information on you wireless and mobile network connection, like your services provider and signal strength;
    • Information on device sensors such as accelerometers, gyroscopes and compasses
  • Other Information with your Consent: if you give us permission, we can collect your precise geolocation through various means, depending on the service and device you are using, including GPS, Bluetooth or Wi-Fi connections. The collection of your geolocation may occur in the background even when you are not using the Services if the permission you gave us expressly permits such collection. If you decline permission for us to collect your geolocation, we will not collect it, however it may be required for the purpose of certain Services on the Platform.

COOKIES AND OTHER SIMILAR DATA COLLECTION TECHNOLOGIES

When you visit our Service, we may assign your device one or more cookies or other technologies that facilitate personalization to facilitate access to our Service and to personalize your experience. Through the use of a cookie, we also may automatically collect information about your activity on our Service, such as the pages you visit, the time and date of your visits and the links you click and also collect information about how you interacted with the online Partners (whether you purchased any goods/ services from their portal). If we advertise, we (or third parties) may use certain data collected on our Service to show you advertisements on other sites or applications.

If you deny the use of Cookies or other such technologies to our Platform on your device, we may not be able to detect your activities on the online Partners portals and resultantly we shall not be liable to credit any reward points (WSP or WRP, as the case may be or commissions) to your Account.

HOW WE USE THE INFORMATION

The main reason we use your information is to deliver and improve our Services. Additionally, we use your information to help keep you safe and to provide you with advertising that may be of interest to you. Therefore, we may use the information collected to:

  • Deliver and improve our Services, and manage our business;
  • Manage your Account and provide you with customer support;
  • Perform research and analysis about your use of, or interest in, our or others’ products, services, or content;
  • Ensure that the payments for the transactions are handled in a proper fashion;
  • Credit the relevant reward points or commission, as applicable, to your Account as exclusive benefits of our Platform;
  • Communicate with you by email, telephone, WhatsApp or other communication mode for notifications with respect to the Services or your Account.
  • Communicate with you by email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you either from us or other third parties;
  • Develop, display, and track content and advertising tailored to your interests on our Service and other sites, including providing our advertisements to you when you visit other sites;
  • Mobile application analytics;
  • To prevent, detect and fight fraud or other illegal or unauthorized activities;
  • Verify your eligibility and deliver prizes in connection with the Lucky Draw or other contests and sweepstakes
  • Enforce or exercise any rights in our Terms;
  • To ensure legal compliance or assisting law enforcement agencies; and
  • Perform functions or services as otherwise described to you at the time of collection.

HOW WE SHARE THE INFORMATION

Since we operate an online marketplace wherein a customer and vendor interact to trade goods/ services, we share some of the information provided by you with other members and our service providers and also with certain other persons as given below:

  • With other users: When using the Platform, you should assume that anything you post or submit on the Platform, may be publicly-viewable and accessible by other Patrons, Partners or Captains or unregistered users (guests). We may, where applicable, share certain payment/ transaction information between users to fulfil the Services.
  • With our service providers: We use third parties to help us operate and improve our Services. These third parties assist us with various tasks, including data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing and security operations. We may also share information with partners who distribute and assist us in advertising our services. For instance, we may share limited information on you in hashed, non-human readable form to advertising partners. We follow a strict vetting process prior to engaging any service provider or working with any partner. All of our service providers and partners must agree to strict confidentiality obligations.
  • For corporate transactions: We may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.
  • When required by law: We may disclose your information if reasonably necessary: (i) to comply with a legal process, such as a court order, or warrant, government / law enforcement investigation or other legal requirements; (ii) to assist in the prevention or detection of crime (subject in each case to applicable law); or (iii) to protect the safety of any person.
  • To enforce our legal rights: We may also share information: (i) if disclosure would mitigate our liability in an actual or threatened lawsuit; (ii) as necessary to protect our legal rights and legal rights of our users, business partners or other interested parties; (iii) to enforce our agreements with you; and (iv) to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.
  • With your consent or at your request: We may ask for your consent to share your information with third parties. In any such case, we will make it clear why we want to share the information.

We may use and share non-personal information (meaning information that, by itself, does not identify who you are such as device information, general demographics, general behavioural data, geolocation in de-identified form), as well as personal information in hashed, non-human readable form, under any of the above circumstances. We may also share this information with other group companies and third parties (notably advertisers) to develop and deliver targeted advertising on our services and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine this information with additional non-personal information or personal information in hashed, non-human readable form collected from other sources.

TRANSFER OF DATA

  • Your information may be transferred to and maintained on devices located outside of India, where data protection laws may differ other those from India. If you are located outside India, you may not use the Services however, if you still use such information, we reserve the right to process your information in India.
  • Winds will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

YOUR RIGHTS

In order to control your information, you may use any of the following:

  • Access/ update tools in the Service: Account settings that help you access, rectify or delete information that you provided to us and that’s associated with your Account directly within the Platform.
  • Device Permissions: Mobile platforms have permission systems for specific types of device data and notifications, such as phone book and location services as well as push notifications. You can change your settings on your device to either consent or oppose the collection of the corresponding information or the display of the corresponding notifications. Of course, if you do that, certain services may lose full functionality.
  • Deletion: We may provide you with the ability to delete your account however, we may still retain certain information for the purpose of compliance with applicable laws of India.
  • Uninstall: You can stop all information collection by an app by uninstalling it using the standard uninstall process for your device. If you uninstall the app from your mobile device, the unique identifier associated with your device will continue to be stored. If you re-install the application on the same mobile device, we will be able to re-associate this identifier to your previous transactions and activities.
  • Complaint: You may lodge a complaint with our customer service or grievance redressal officer for any data related query on your account.

HOW WE PROTECT YOUR INFORMATION

  • We work hard to protect you from unauthorized access to or alteration, disclosure or destruction of your personal information. As with all technology companies, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information will always remain secure.
  • We regularly monitor our systems for possible vulnerabilities and attacks and regularly review our information collection, storage and processing practices to update our physical, technical and organizational security measures.
  • We may suspend your use of all or part of the Services without notice if we suspect or detect any breach of security. If you believe that your account or information is no longer secure, please notify us immediately at the customer service or grievance redressal officer. We will not be liable for any such breach where you have failed to inform us immediately.
  • Particularly with respect to Lucky Draws, in case you as a Participant win any prize in the Lucky Draw, our only obligation shall be to remit the prize money to the bank account validated on your Account. We shall not be liable in case any such bank account provided on your Account does not belong to you or if you are unable to utilize the funds.

SECURITY

  • The security of your data is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot, in any manner whatsoever, guarantee its absolute security. Unfortunately, no internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur.
  • If you ever think someone has had access to your password or Account, please follow the steps set out here. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk.

POLICY CHANGES

We take privacy seriously and therefore, from time to time we may amend, change, rescind and/or update this Policy to reflect the same. We also amend this Policy if there is any change in our business model. Your continued use of the Platform would be deemed acceptance of any change in this Policy. It shall be your responsibility to keep yourself updated with any change and regularly review this Policy along with the Terms. If you disagree with any provision of this Policy, you may stop using the Platform.

In the event of any violation by any user of this Policy or any inconsistent application of this Policy on the Platform or contravention of the laws, you may provide your concerns in writing to us at:

Additionally, you may also contact us via the address given below. When something gets reported to Winds, we review it and act accordingly. We don’t include any information about the person who filed the report when we contact the reported persons. However, please note that reporting something to us does not guarantee that it will be removed as we be legally bound to retain certain things.

MISCELLANEOUS

  • Children’s Privacy: Our Services do not cater to anyone below the age of 18 years. Winds cannot personally identify if a person is 18 years of age or not, therefore it is the responsibility of the parent or guardian of anyone below the age of 18 years to ensure they do not access our Services/ Platform. If we are notified of any such person (below the age of 18 years), we shall immediately prohibit their access to our Platform.
